Transitioning from Asylum to Permanent Residency: Tips for Applying for a Green Card

  1. Once an individual's asylum application has been approved, they can file Form I-485, Application to Register Permanent Residence or Adjust Status, to become a lawful permanent resident (receive a green card) in the United States. However, there isn't a specific waiting period mandated by the United States Citizenship and Immigration Services (USCIS) after asylum approval before filing Form I-485.

  2. The decision to apply for adjustment of status (I-485) after receiving asylum approval depends on various factors and individual circumstances. Some considerations include:

  3. Waiting for Eligibility: While there might not be a mandated waiting period, some individuals might wait for certain conditions to be met before applying for adjustment of status, such as reaching a specific milestone, ensuring financial stability, or other personal reasons.

  4. Validity of Asylum Approval: Asylum approval grants lawful status in the U.S. After approval, individuals generally have the right to remain in the country indefinitely as asylees.

  5. Timing and Intentions: Individuals can choose to file for adjustment of status at their convenience after asylum approval, considering their future plans, eligibility criteria, family circumstances, and any other factors influencing their decision to pursue lawful permanent residency.

  6. EAD and Travel Document: Asylees might also consider applying for an Employment Authorization Document (EAD) and Refugee Travel Document after asylum approval if they wish to work legally in the U.S. or travel internationally.

  7. While there is no mandatory waiting period to file Form I-485 after asylum approval, it's essential to ensure eligibility and complete the application accurately. Asylum recipients should assess their individual situation, consult with an immigration attorney or accredited representative, and carefully consider their options before proceeding with the adjustment of status application.
